PLAIN-LANGUAGE SUMMARY

Cameron Tendler Coaching uses health-related information only when it is reasonably connected to the fitness, performance, assessment, nutrition, or coaching services a person requests. We do not sell consumer health data. We do not use consumer health data for targeted advertising. Public use of a client’s photo, video, testimonial, name, or progress information requires a separate optional authorization.

This policy explains what consumer health data we may collect, where it comes from, how it is used and processed, who may receive it, and how a consumer can exercise privacy rights. It is intended to address Nevada’s consumer-health-data requirements when they apply. Other privacy laws may provide additional rights.


1.

Who This Policy Covers

This policy applies to consumer health data collected or controlled by Cameron Tendler doing business as Cameron Tendler Coaching, and later by any successor legal entity identified in an updated policy, in connection with private coaching and related services.

Cameron Tendler Coaching is a fitness and performance coaching business, not a medical practice. Coaching records are not represented to be HIPAA medical records. This policy does not apply to information that has been lawfully de-identified so it is no longer linked or reasonably capable of being linked to an identifiable consumer, or to information otherwise excluded by applicable law.

Consumer Health Data We May Collect

Depending on the service requested, Cameron Tendler Coaching may collect:

• health and safety information you choose to provide, including relevant conditions, symptoms, pain, injuries, surgeries, restrictions, pregnancy status when applicable, medications that may affect exercise, clearance status, and professional restrictions;

• assessment and movement information, including mobility, balance, gait, range of motion, technique, images or video, assessment answers, measurements, scores, and coach observations;

• fitness, training, activity, recovery, and readiness information, including workouts, loads, repetitions, duration, performance, soreness, sleep, stress, fatigue, heart-rate or wearable information when connected, and progress trends;

• nutrition and lifestyle information when relevant to a service you request, including food preferences, allergies or intolerances, eating patterns, food logs, meal photographs, hydration, supplements, and general nutrition habits;

• body and progress information, including height, weight, body measurements, body-composition estimates, progress photographs, and performance benchmarks;

• coaching communications and records, including check-ins, messages, call notes, questionnaires, goals, feedback, barriers, and accountability information; and

• information derived or inferred from the categories above, such as readiness indicators, assessment outputs, trends, risk flags, and coaching conclusions.

Cameron Tendler Coaching does not need every category from every client. We aim to collect only information reasonably connected to the service requested and safe, individualized coaching.

Sources of Consumer Health Data

Consumer health data may come from:

• you, through forms, assessments, check-ins, messages, calls, videos, photographs, or other voluntary submissions;

• Cameron’s observations during coaching or assessment review;

• Everfit, Revenite, SmartEat when separately selected, wearable integrations, or another platform you choose or that is disclosed for the service;

• a healthcare professional only when you direct or authorize the professional to provide information or when you provide the information yourself; and

• information reasonably derived from the data above.

Cameron Tendler Coaching does not routinely request complete medical records. If medical clearance or restrictions are needed, the client is ordinarily asked to obtain and provide the relevant clearance or restrictions.

How We Use and Process Consumer Health Data

We may access, receive, organize, store, review, analyze, derive, transmit, update, and delete consumer health data for these purposes:

• determine appropriate exercise boundaries and whether clarification or medical clearance is needed;

• administer and interpret fitness or movement assessments;

• design, deliver, modify, progress, regress, or pause individualized training;

• monitor performance, adherence, recovery, readiness, symptoms, and progress;

• provide nutrition education or a separately purchased nutrition service within Cameron Tendler Coaching’s permitted scope;

• communicate with you, answer questions, review check-ins and technique, and document coaching decisions;

• operate enrollment, scheduling, platform access, consent records, client support, and service administration;

• maintain security, prevent misuse, investigate incidents, and comply with legal obligations; and

• respond to an immediate safety concern when reasonably necessary.

Cameron Tendler Coaching does not make material coaching-eligibility decisions solely through automated processing without human review.

5.

Categories of Data We May Share and Recipients

Only information reasonably necessary for the disclosed purpose or requested service should be shared. Depending on your services and choices, recipient categories may include:

• training/coaching platforms such as Everfit or a disclosed replacement;

• assessment platforms such as Revenite or a disclosed replacement;

• nutrition platforms such as SmartEat only when that optional service is separately selected and any required consent is completed;

• email, video-conferencing, scheduling, electronic-signature, cloud-storage, document-management, website, security, and technical-support providers;

• payment processors, which may receive limited account, transaction, subscription, billing-status, and fraud-prevention information, while complete payment credentials are handled directly by the processor;

• professional advisors, insurers, accountants, or attorneys when reasonably necessary for legal, insurance, tax, security, or compliance purposes;

• emergency services or an emergency contact if information is reasonably necessary to request assistance; and

• courts, regulators, law enforcement, or other recipients when disclosure is required or authorized by law.

Cameron Tendler Coaching currently identifies no affiliate that receives consumer health data. If a materially new category of data, purpose, recipient, or affiliate is added, Cameron Tendler Coaching will update this policy and obtain additional consent when required before the new collection, use, or sharing occurs.

6.

No Sale, No Health-Data Targeted Advertising, and No Prohibited Geofencing

Cameron Tendler Coaching does not sell consumer health data and this policy does not authorize a sale. Cameron Tendler Coaching does not use consumer health data for targeted advertising. Cameron Tendler Coaching does not use prohibited geofencing around in-person health-service locations to identify or track consumers, collect consumer health data, or send health-related advertising.

This policy also does not authorize public marketing use of client photos, videos, testimonials, names, or progress information. That requires a separate optional written authorization.

7.

Website and Cross-Site Collection

Cameron Tendler Coaching does not intentionally place advertising pixels or cross-site behavioral tracking tools on health questionnaires, assessments, check-ins, or other pages specifically used to collect consumer health data. Public marketing pages may use ordinary website functionality or analytics under a general website privacy notice, but Cameron Tendler Coaching does not intend to configure those tools to receive consumer health data.

At the time of this policy, Cameron Tendler Coaching does not knowingly permit a third party to collect consumer health data over time and across unrelated websites or online services through Cameron Tendler Coaching’s health-data forms or coaching services.

8.

Retention and Security

Cameron Tendler Coaching retains consumer health data only as long as reasonably necessary to provide requested services, maintain appropriate coaching and consent records, comply with law, address disputes or insurance needs, and operate the business responsibly.

Cameron Tendler Coaching uses reasonable administrative, technical, and physical safeguards appropriate to the nature and volume of the information. Access should be limited to people and processors who reasonably need the information for an authorized purpose. No electronic system or transmission method can be guaranteed completely secure.

9.

Your Privacy Rights

Subject to applicable law and successful identity authentication, a consumer may request that Cameron Tendler Coaching:

• confirm whether Cameron Tendler Coaching is collecting, sharing, or selling consumer health data relating to the consumer;

• provide a list of third parties with whom Cameron Tendler Coaching has shared that consumer health data or to whom it has been sold;

• cease future collection, sharing, or selling of consumer health data as applicable;

• delete consumer health data concerning the consumer; and

• allow review or correction of inaccurate information maintained directly by Cameron Tendler Coaching when reasonably available.

A consumer may also withdraw a prior consent to future collection or sharing and may appeal a refusal to act on a privacy request. Exercising a privacy right will not result in unlawful discrimination.

10.

How to Make a Privacy Request

Email privacy@camtendler.com with the subject line “Consumer Health Data Request.” You may also mail a request to the business address listed at the top of the published policy. Do not include unnecessary sensitive health details in the initial request.

Cameron Tendler Coaching will use commercially reasonable steps to authenticate the requester before disclosing, changing, or deleting information. Verification may include a reply from the enrolled email address, platform authentication, a signed request, or other information reasonably necessary to prevent unauthorized access.

Cameron Tendler Coaching will respond without undue delay and generally no later than 45 days after authenticating a request. When legally permitted and reasonably necessary because of complexity or multiple requests, Cameron Tendler Coaching may extend the response period by up to 45 additional days and will provide notice of the extension within the initial period.

For an authenticated deletion request covered by Nevada consumer-health-data law, Cameron Tendler Coaching will generally delete covered data from active records and notify applicable recipients within 30 days, subject to lawful exceptions. Deletion from archived or backup systems may be delayed for the period permitted by law.

Appeals

If Cameron Tendler Coaching refuses to act on a covered privacy request, the response will explain the decision and how to appeal. To appeal, email privacy@camtendler.com with the subject line “Privacy Appeal” and identify the original request and the reason for reconsideration.

Cameron Tendler Coaching will provide a written response to a covered Nevada appeal no later than 45 days after receiving it. If the appeal is denied, the response will include contact information for the Nevada Office of the Attorney General as required by applicable law.

12.

Material Changes

Cameron Tendler Coaching may update this policy to reflect legal, operational, technology, or service changes. Material changes will be communicated clearly, such as through email, the coaching platform, the website, or delivery of an updated policy. When applicable law requires additional affirmative consent for a materially new data category, purpose, recipient, or sharing practice, that consent will be obtained before the change applies to the affected consumer health data.

13.

Minors and Information About Other People

Private Coaching currently enrolls adults age 18 or older. Do not submit another person’s health information, photographs, videos, audio, or medical documents unless you have lawful authority and Cameron Tendler Coaching has agreed to receive them.
